1. Acceptance of Terms

By accessing or using CarCall, you agree to comply with these Terms & Conditions. If you do not agree, you must not use the platform.

2. Description of Service

CarCall provides:

  • QR-based vehicle identification
  • Emergency contact and alert system
  • Communication between users and vehicle owners
  • Commission-based distribution system (Agents & Retailers)
  • Wallet and withdrawal functionality

3. User Roles

The platform operates with multiple roles:

Admin
Agent
Retailer
Owner/User

Each role has restricted access based on permissions.

4. User Responsibilities

You agree to:

  • Provide accurate and valid information
  • Not misuse emergency features
  • Not attempt unauthorized access
  • Maintain confidentiality of your login (OTP-based)

5. Prohibited Activities

Users must not:

  • Use the platform for illegal purposes
  • Send false emergency alerts
  • Attempt fraud in commissions or withdrawals
  • Interfere with system operations

6. Payments & Wallet

  • Wallet balances reflect earned commissions
  • Withdrawals are subject to approval and thresholds
  • CarCall is not responsible for delays caused by payment providers
  • Incorrect withdrawal requests are user responsibility

7. Emergency Feature Disclaimer

  • CarCall facilitates communication but does not guarantee emergency response
  • Users must still contact official emergency services when required
  • We are not liable for delays or failures in emergency handling

8. Limitation of Liability

CarCall shall not be liable for:

  • Indirect or consequential damages
  • Loss of data or earnings
  • Misuse of the platform by users

9. Governing Law

These terms are governed by the laws of India.

10. Legal compliance (India – IT Act + GDPR-lite)

10.1 Applicable Laws

CarCall complies with the Information Technology Act, 2000, IT Rules (Reasonable Security Practices), and Digital Personal Data Protection Act, 2023 (DPDP Act).

10.2 User Rights (DPDP Act)

  • Access their data
  • Correct inaccurate data
  • Request deletion
  • Withdraw consent
